Commercial Drivers License

Interstate Highway I-75 goes right through Cobb County and Cherokee County.  So, local and out of state commercial drivers are our regular clients. We know that a minor traffic ticket for anyone else is a major problem for you. Both Federal Law and Georgia State Law establish the criteria for commercial driver’s license disqualifications. A person is disqualified from driving a commercial vehicle for at least 60 days if convicted of 2 serious traffic violations within a 3 year period, and 120 days for 3 serious traffic violations within a 3 year period, whether in a commercial or non-commercial vehicle. Some serious traffic violations include speeding more than 15 mph over the speed limit, reckless driving, following too closely, improper lane change, a railroad crossing violation, and driving a commercial vehicle without obtaining a commercial driver’s vehicle.  Any person is disqualified from operating a commercial vehicle for at least one year if convicted of a first violation: failure to report striking an unattended vehicle or fixed object, failure to report an accident, driving a commercial vehicle with a BAC of more than .04, DUI in a commercial or non-commercial vehicle, and refusing to submit to a breath test.  A conviction of 2 or more of these offenses, within a 5 year period, results in disqualification for life! We understand that a nolo plea will not be accepted for any conviction received in the operation of a commercial vehicle, so our goal is always to reduce the ticket to a non-moving violation.

Q: Will I have to come to court?
A: Commercial drivers do not have to appear if they have a lawyer.

Q: Will Georgia notify my licensing state?
A: Yes. If your home state is part of the Interstate Compact, then there are no “non-reporting” commercial tickets. Therefore, getting the ticket reduced to a non-moving violation is important.
